Welcome to Synopheme! These Terms of Service (“Terms”) govern your use of our website, puzzle games, and related services (collectively, the “Service”).
By using our Service in any manner, you agree to these Terms. Please read them carefully. If you do not agree, you may not use the Service.
1. Our Service
Synopheme provides a daily word-puzzle game where users connect a start word to an end word through a chain of synonyms. The Service is accessible via our website at https://synopheme.com/ and its subdomains. Our goal is to provide a fun and educational experience.
2. Key Terms
Here are the definitions of key terms used in this document. They are listed alphabetically.
- Account: Your registered profile for accessing certain features of the Service.
- Content: All text, graphics, puzzles, hints, and other materials we provide through the Service, including its "look and feel."
- Intellectual Property: All patents, copyrights, trademarks, trade secrets, and other proprietary rights.
- Puzzle: A set of seven words (a source word, a target word, and five hidden steps) released daily and identified by date.
- Service: Our website, puzzle games, Content, and related services.
- User: Any person who accesses or uses the Service.
- User Content: Any data, feedback, or input you provide, including your guesses and game progress.
- We/Us/Our: Synopheme and its affiliates.
- You/Your: Any person who accesses or uses the Service.
3. Your Rights and Responsibilities
3.1 What You Can Do
We grant you a limited, non-exclusive, non-transferable, and revocable license to:
- Play our daily and historical puzzles for personal, non-commercial enjoyment.
- Share and discuss puzzle solutions for educational or entertainment purposes.
3.2 What You Cannot Do
Your use of the Service must be lawful and in accordance with these Terms. You agree not to, without our prior written permission:
- Use the Service for any commercial purpose.
- Reverse-engineer, decompile, or otherwise try to derive the source code or logic behind the puzzles.
- Scrape, harvest, or collect data from the Service, whether manually or through automated means.
- Interfere with or disrupt the integrity or performance of the Service.
- Introduce viruses, malware, or any other malicious code.
- Attempt to bypass our security measures or gain unauthorized access to any part of the Service.
- Create derivative works based on our Content.
3.3 Account Security
You are responsible for keeping your account credentials secure. Please notify us immediately at support@synopheme.com if you suspect any unauthorized use of your account.
4. Our Intellectual Property and Your Content
4.1 Our Ownership
All right, title, and interest in the Service and its Content—including all Intellectual Property—are the exclusive property of Synopheme and its licensors. These Terms do not grant you any rights to use the Synopheme name, logo, or trademarks.
4.2 Your License to Us
When you submit User Content (like your game progress or feedback), you grant Synopheme a perpetual, royalty-free, worldwide license to use, host, reproduce, modify, and display such User Content.
5. Disclaimers and Limitation of Liability
5.1 Our Service is Provided "As Is"
We work hard to provide a great Service, but we cannot guarantee it will always be perfect. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This means we do not promise that the Service will be uninterrupted, error-free, or completely secure.
5.2 Limitation of Our Liability
To the maximum extent permitted by law, Synopheme and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
6. Termination
6.1 Termination by You
You are free to stop using our Service at any time. You can request the deletion of your account by contacting us at support@synopheme.com.
6.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we believe your actions could cause harm or legal liability. This includes, but is not limited to, situations of prolonged inactivity, security risks, or illegal conduct.
6.3 Effect of Termination
Upon termination, your license to use the Service ends. We may delete your account and User Content. Sections 4, 5, 6, 8, and 10 of these Terms will continue to apply even after termination.
7. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on this page and update the "Last Updated" date. For significant changes, we will provide more prominent notice, such as through an in-game notification or by email. Your continued use of the Service after the changes take effect means you agree to the new Terms.
8. Governing Law and Dispute Resolution
8.1 Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-law principles.
8.2 Dispute Resolution Process
We hope to resolve any disagreements amicably. Before filing a formal claim, you agree to first try to resolve the dispute informally by contacting us at support@synopheme.com.
If we cannot resolve the dispute informally within 30 days, either party may initiate binding arbitration. The arbitration will be conducted in Nairobi, Kenya, under the Arbitration Act (No. 4 of 1995) of Kenya by a single arbitrator. Each party will bear its own costs.
This arbitration clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction to prevent the imminent infringement or misappropriation of its Intellectual Property.
9. Eligibility and Compliance
9.1 Age Requirement
You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
9.2 Data Privacy
We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you agree to our data practices as described in the Privacy Policy.
10. Miscellaneous
- Assignment: You may not assign your rights under these Terms, but Synopheme may assign its rights to an affiliate or in connection with a merger or sale of assets.
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Synopheme regarding the Service.
- No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
- Severability: If any part of these Terms is found to be unenforceable, the remaining parts will stay in full force and effect.
- Waiver: If we fail to enforce a provision, it is not a waiver of our right to do so later.
